Every session requires this agreement signed digitally. It is signed right after paying the deposit.
This agreement is between Felipe Restrepo Photography ("the photographer") and the person who signs it when booking ("the client"), and applies to the boudoir session booked and to the collection the client chooses. What each one includes:
Session ($450): consultation, 90 minutes of shooting, hair and makeup, wardrobe styling, a same-day reveal and 5 retouched images.
Esencia ($895): 15 retouched images and their digital files.
Musa ($1,695): 30 retouched images, an 8×8 album and digital files.
Icono ($2,795): every image in the curated gallery retouched, a 10×10 album and 16×20 wall art.
The collection may be paid in 3 installments. Anything not listed in the package is not included (clause 11). By signing, both parties agree to all of the clauses below.
A deposit of 50% of the package price reserves the date. The deposit is non-refundable, except as stated in clauses 4 and 5. The remaining balance is due in full on the session day BEFORE any photographs are taken: the photographer does not begin photographing until 100% of the package price has been paid. If the client does not pay the balance, the session does not take place and is treated as a cancellation by the client (clause 4). When the client pays the deposit by card on the website, she authorizes the photographer to store that card securely with Square and to charge the balance automatically on the session day, before the session starts; if that charge is not approved, the client must pay the balance by another method before any photographs are taken. While any balance is unpaid, the photographer may withhold the gallery and any products. Balances unpaid more than 15 days after the session may carry a reasonable administrative fee, disclosed to the client in advance. If the client chooses to pay by Zelle or Bitcoin instead of card, she pays the 50% deposit when booking, sending it to the account shown with its reference code, and the date is confirmed once the deposit arrives. The remaining 50% is paid by the same method no later than the day before the session. Bitcoin amounts are fixed in US dollars at the exchange rate at the time of each payment, and any refund owed is made in US dollars.
The time is held for 48 hours from the booking request. The client pays the deposit within that window and signs this agreement right after paying it. The session is confirmed once the deposit is paid and this agreement is signed; the photographer does not photograph any session without this signed agreement. If the deposit is not paid within 48 hours, the time is released with no obligation for either party. By paying the deposit, the client accepts these deposit and cancellation terms.
The client has 24 hours after paying the deposit to cancel for a full refund, as long as the session is not scheduled within that same period. After that grace period, any cancellation forfeits the deposit. If the client cancels less than 7 days before the session and the balance has already been paid, the balance is also non-refundable unless otherwise agreed in writing.
If illness, an emergency or another cause beyond the photographer's reasonable control prevents the session, the photographer will offer to reschedule at no cost or, if that is not possible, refund everything paid, including the deposit. In no case will the photographer's liability for this cause exceed the amount paid by the client.
The client may reschedule ONCE at no cost with at least 48 hours' notice, subject to availability. A second change, or a change with less than 48 hours' notice, may carry an administrative fee or forfeit the deposit, at the photographer's discretion.
The session takes place on location at the home, hotel or Airbnb chosen by the client within Miami-Dade, Broward or Palm Beach counties. Locations outside that area may carry a travel fee agreed in advance. The client is responsible for the location being available, for having permission to photograph there, and for any venue costs. The photographer never publishes or shares the session address.
The client confirms she is at least 18 years old and will show valid ID if asked. The client sets her own limits: she will never be asked to show more than she wants, and she may pause or end the session at any time. A trusted companion may be present if arranged in advance. The photographer may end the session without refund in the event of abusive, threatening or unsafe conduct by anyone present, and will deliver the images captured up to that point.
Hair and makeup are included in the $450 session and in the collections, and are scheduled before it starts. Exception: in the Founding Muse session ($250, November 2026, 10 spots), hair and makeup are NOT included; the client arrives with her hair and makeup already done. Delays caused by the client may reduce photography time without refund.
Images are delivered in a private, password-protected online gallery. Preview gallery (unedited proofs, to pick favorites): within 24 hours after the session. Edited images (included retouching): within 7 days after the client tells us she has chosen. Advanced retouching: within 10 days after the client tells us her picks, or after payment when it is an extra. Rush (less than one week): +$5 per image. Albums and wall art follow print production times. Timelines may pause while a balance is unpaid, and the client will be notified of any significant delay. The gallery stays online for at least 90 days, after which it may be archived or removed, so the client should download and back up her images.
Included retouching (basic): the photographer's color and tone style; exposure, light, contrast and white balance; straightening and cropping when it improves the image; gentle skin cleanup (temporary blemishes and redness) that keeps real skin texture; and removal of small distractions. Included retouching never changes the shape or size of the body. Substantial style changes are not made on individual request. Additional albums start at $350.
Advanced retouching (by hand, by our retouching team; quoted per photo and paid before work begins): reshaping or slimming the body or face (liquify); smoothing clothing that clings to the body or shows rolls, and wardrobe wrinkles; heavy skin smoothing or changing skin texture; removing people or large objects; changing, replacing or extending backgrounds or skies; opening closed eyes or swapping faces between images; composites; and a different editing look on specific images. Cumulative rates per order: 1 to 4 images, $25 each (3 images = $75); 5 images, $100; 6 to 9 images, $100 plus $20 for each image over 5 (7 images = $140); 10 images, $150; 11 to 20 images, $150 plus $15 for each image over 10 (15 images = $225; 20 images = $300); 21 or more, $300 plus $10 for each image over 20 (25 images = $350). The client always pays the lower price: if the next package costs less than her number of images, she pays the package and receives its full quantity (9 images cost $150 and she receives 10). We always say so before payment if a change is not possible or would not look natural.
Extra edited images (included editing, beyond the package), cumulative rates: 1 to 4 images, $10 each (3 images = $30); 5 images, $35; 6 to 9 images, $35 plus $7 for each image over 5 (8 images = $56); 10 images, $50; 11 or more, $50 plus $3 for each image over 10 (20 images = $80). Here too the lower price applies (9 images cost $50 and she receives 10; 4 images cost $35 and she receives 5).
Rush: if the client needs her edited images in less than one week, add $5 per image, on any package and on top of any advanced retouching.
Out-of-scope requests are done only after the client accepts a written quote from the photographer (email or text is fine) and, when the quote says so, after payment. Messages from the team or assistants, including automated messages, may describe or estimate a service but never change this agreement or add anything to a package; only a written confirmation from Felipe Restrepo can. A courtesy edit is a one-time gift and does not change what the package includes.
RAW files (the original, unprocessed camera files, such as .CR3, .ARW or .DNG) and any other original, unprocessed files are not delivered under any package and are not available for purchase or for an additional fee. They remain the photographer's exclusive property. The client receives processed images: the preview gallery and the edited images. The photographer selects, with professional judgment, the images shown and delivered.
The photographer is the sole copyright owner of all images under United States copyright law. The client receives a personal, non-exclusive, non-transferable license to print her images, share them on her personal social media and use them in products for herself. The license does not include commercial use, resale, licensing to third parties or substantial alteration (including filters that significantly change the edit) without the photographer's written permission.
The client irrevocably authorizes Felipe Restrepo Photography to use images from the session in its portfolio, website, social media, publications and its own advertising, without additional compensation. This authorization is an essential condition of this agreement and of its price; the photographer does not provide the service without it. The photographer never publishes the client's full name, contact details or location alongside the images, and never sells the images to third parties.
The only way to exclude images from the portfolio or social media is a separate privacy agreement, negotiated and signed in writing BEFORE booking and paying the deposit (not afterwards, not verbally, and not through a note in the booking). Such an agreement is at the photographer's sole discretion and may carry an additional fee. If this agreement is signed without that prior written agreement, this authorization is final.
The client's information (name, email, phone, session location) is used only to provide the service, communicate about the session and keep internal records. It is not sold or shared with third parties for marketing, unless required by law.
Because this is an intimate session, the photographer brings an assistant only with the client's prior consent.
The photographer is not liable for delays or failures caused by events beyond reasonable control (severe weather, natural disasters, public health emergencies, closures or government restrictions); in that case the session is rescheduled at no cost. The photographer uses professional equipment with reasonable backups, but in the event of a technical failure or loss of files beyond reasonable control, liability is limited as stated in clause 18.
The photographer's total liability for any reason related to this agreement will not exceed the amount paid by the client for the session. The photographer is not liable for indirect, incidental or consequential damages.
If the client does not love her photos, we reshoot, with no session fee. She must ask within 7 days of her reveal; one reshoot per session, at the same kind of location.
The client will hold the photographer harmless from claims, damages or reasonable expenses arising from (a) injuries or damage caused by the client or her companions during the session, (b) use of a location without the necessary permissions, or (c) false statements by the client, including about her age.
Communications about this agreement may be made by email, text message or WhatsApp to the contact details the client provided when booking, and are considered delivered when sent.
The client may not assign this agreement without the photographer's written consent. This agreement changes only in writing (email or text is fine) with a confirmation from Felipe Restrepo or a written quote from the photographer that the client accepts; messages that describe or estimate a service do not amend it. Not enforcing a clause at a given time does not waive it. This is the entire agreement regarding the session and replaces any prior agreements; if any clause is found invalid, the rest remains in effect. The clauses on copyright, use of images, limitation of liability, indemnification and privacy survive the session.
This agreement exists in English and Spanish; in case of any difference between the two versions, the English version prevails.
This agreement is governed by the laws of the State of Florida. In case of a disagreement, the parties will first seek a direct, good-faith solution; failing that, the dispute will be resolved in the courts of Palm Beach County, Florida. The prevailing party in any legal proceeding arising from this agreement may recover reasonable attorney's fees and costs.
By checking the acceptance box and typing her full name when signing this agreement, the client confirms that she has read, understood and accepts this entire agreement, and that this electronic signature has the same validity as a handwritten signature under the federal ESIGN Act and Florida law. The photographer keeps a record of the version signed, the date and time, the package, the IP address and a digital fingerprint (hash) of the text.
